They really did say they are relocating to the UK, which they think, and I hope so, will allow them to bypass Pact, as Toque said the US mail must comply with British Post.ops:. I will miss my three day shipping and product selection from NicotineRush. I've been buying snus online from the Northerner since 2001 and this PACT act bulls@*t is going to just suck.

Originally posted by Mr.SnuffNow that this law has passed, I would like to tap into the collective brain-power of this erudite group. I am not a lawyer, and hence may be completely off-base, but:
1. It seems to me that this law is likely to be challenged in court
2. There is a reasonable chance it is unconstitutional and/or goes against Indian Nation treaties.
3. If 1 and 2 are valid, there is a reasonable chance it will be quashed.
Given that 1,2 and 3 are likely to transpire then it seems completely nonsensical for us to spin our wheels getting registered in every State, County and City that have their own convoluted tax laws which they are not set up to enforce in any case. In 90 days we will not be able to ship to customers without paying the taxes FIRST. It is impractical to send a check in to the tax collecting authorities for every sale that is made. Even if we set all this up, if 3 happens then we will have totally wasted our time and money, and meanwhile made ourselves uncompetitive with our European friends.
Given that scenario, we have very reluctantly made the difficult business decision to shift all our operations over to the UK. This is, I hope, a temporary measure. As soon as the whole PACT nonsense works its way through the various courts, and when States and localities have automated their tax collection procedures (if indeed it comes to that), then we will re-open the US operation and shift everything back Stateside. You have no idea how it saddens me that things have come to this, but from a business perspective I see no other option.
The good news is that Tom at nicotinerush will also be staying in business. The details have to be hammered out, but both of us, from today, will be operating out of the UK. The same selections of snuff will be available as always. You will not notice any disruption in service. Eventually prices might squeak up a bit because obviously we will need support staff in the UK, as well as a warehouse and an office. But any price increase will not make us uncompetitive and of course will still be a whole lot less than the taxes which may or may not be collected by the Post Office when you receive your package.
This is how things are right now, and frankly, we have gone over and over and over every option we can think of. If we want to stay in business in the short term, we can see no other option. Long term it will more than likely viable to open up again the US. And that of course is what we are planning to do.
For what it is worth we plan on keeping the wholesale business stateside and fully operational. So if any of the other plans mooted on this site transpire then we will be here ready to ship to any licensed retailer.
Here is where I need your help. If you see any flaws in this plan, please speak up. If you see any reasonable alternatives that do not involve breaking the law and risking having to learn how to put on lipstick, please share your thoughts.
Speaking for both Tom and myself (we have spent a good chunk of the morning on the phone) we both really appreciate everybody's support during this chaotic time. You have no idea how valuable it is and (risking being maudlin here) heart-warming. It really does give us extra incentive to keep going. Apart from anything else, to just roll over to a pathetic, ill conceived, impractical, unenforceable law is not part of our modus operandi. Period. Why the hell snuffers in the US, this intelligent, educated group of 'outsiders', should have their innocent passions which affect NOBODY else, stolen from their enjoyment of life is beyond us, and is not something that will garner any support from our corner. Ok now I am getting on my soapbox, so I will stop.
All answers, comments, suggestions, advice etc very gratefully received.
Dave
