In the meantime I would (a) see if the marriage with Northerner is a possibility (b) legally solidify the agreement (c) establish a working time frame of when Northerner's new phase is actually going to take place and (d) determine a concrete event within Northerner's implementation that will indicate when Toque should begin it's compliance work (when x happens Toque begins the process).

From my perspective I would need to have more than "a great idea" or a "fantastic scenario" to invest the resources that compliance would require. I would also like to see the numbers comparing B&M sales verses internet sales in the USA to see if even exclusive rights to 1000 US stores nation wide would move the volume that an equal investment in internet sales would yield.

At the same time, I am not throwing a proverbial turd in the punch bowl. If traditionally B&M sales of snuff in the USA show merit of investment, then to not move would be foolish.

Again I would be looking for numbers and not scenarios
Yea, that all makes sense. I wonder how difficult it is to get snuff ingredients. That could be easy or complex depending on exactly what the government wants.

One thing I did no realize (nor do I think the law makers realized it either) is the defacto exemption they gave pipe tobacco. It is simply not mentioned by the law and therefore not included under its restrictions. Therefore, all the pipe shops are simply going on with business as usual (and rightly so).

Now here is the relevance: These shops are all unloading their snuff, dip, RYO and snus because these products (and not pipe tobacco or cigars) require the collection of state taxes. In other words, to carry even an FDA approved snuff would require a mountain of paper work that otherwise these stores will avoid by simply discontinuing the product and sticking to pipes and cigars.

Case in point read this blurb from Mike's News letter over at Mars Cigars & Pipes

The point of all this is- As of right now Getsnus seems to be the only store in the USA that might (and I stress might) be open to selling nasal snuff over the internet since they will already have to comply with state tax collection. However, as of now even Getsnus does not sell snuff.

The result is that Roderick's mammoth effort to comply with the FDA will yield him at best 1 store in the whole country willing to carry his product with the great likelihood that that number WILL REMAIN at the current 0.

So tell me............... would you do it?

      Your Honor..............

      the Council for Toque rests
Uh, I hate to throw a monkey wrench in the argument but Getsnus/Northerner DOES carry snuff and Poschl is more than a step ahead in the race right now. Whether they have FDA approval remains to be seen after June 29. Full speed ahead Roderick!

You are right! I forgot that they had some Poschl. However, whether Poschl is FDA registered is another mater (that I do not know).

However the point still remains....we are looking at only one store, Getsnus.

The B&M option to me still remains very limited in its potential. I just don't see many local markets being able to support a full range or even a partial range of snuffs (without internet sales to augment and fall back on). My guess is that Poschl will register Pacard's and President's for it's US B&M stores and be done with it.

I asked the guy at my local tobacco shop if he could order wilsons snuff. He pulled out a list about 6 pages long, looked for what I wanted, found it, ordered it, and I got my snuff WoS Menthol Plus.

Maybe I need to go see whats exacty on his list. I'm sure it just the real popular snuffs tho.

I've been wrong lots of times.  Lots of times I've thought I was wrong only to find out that I was right in the beginning.

Of course it is Northerner owned & operated now. But they evidently do or will have the software in place for applying state and federal taxes so if Toque could get registered...I see that they sell Toque on the Northerner main site so they've already got their foot in the door. I've never bought from Northerner but if if was my only option for Toque I certainly would.

The work Toque or anyone has to do to get the FDA ok, I don't know, but the snus companies are doing it, so I suspect it can be done. The state collecting taxes is another subject. But this would ensure getsnus could sell it, and local shops too, I mean, it might open a new market for them. This all is under the impression that nasal snuff needs the FDA ok, it seems unknown depending on who one is talking to. If it is, I suspect Poschl will comply, because it's their snuff I see the most of in the US.
