There has been some other stuff going on behind the scenes as well, regarding setting a precedent for the use of the Federal Government's Police Powers to enable state sales tax collections for all e-commerce. The PACT Act would have created a very dangerous precedent in this regard. Sec. 10 of The Act addresses this concern by stating that it was not the "intent" of the Bill's authors to use Federal Government Power to tax internet sales of other good, but "intent" has nothing to do with it; the "camel's nose" would be under the tent.

This is great news, though I don't have a good sense of how long it is likely to ultimately forestall the legislation. PACT (or something similar) is still most probably a question of when rather than if. So I'm still glad that I've been slowly stocking up on snus, too.
The NY Times arrogant comments about a national consensus just kills me... But sagedill's point about the GOP is well-taken too. Why anyone with an authentic enthusiasm for individual liberty would see the Republicans as somehow on their side is way, way beyond the capacity of my fuzzy little mind to understand.
It's just special interest power-jockeying as usual, but three cheers for the Seneca, whatever their motives.

Sage I hope you are not exercising wishful thinking. I don't see anything in that article about PACT being dead.
...Senate Democratic leaders could still revive the measure, perhaps by attaching it to some other bill. Republicans have talked of pushing forward, possibly to make trouble for Ms. Gillibrand. But even if it did pass, Mr. Nephew said, it would ban only cigarette shipments and not cigars. “I guess there are a lot of cigar smokers in Washington and places where powerful people hang out,” Mr. Nephew said. “It appears that they are protecting their own habit.”

I am not sure why people think this bill is dead when it is not. It does look like it is on life support for now but could also be revived in the future. As for as these arguments about the federal governments powers to regulate the internet, just take a look at this article on wikipedia about internet gambling and the laws those "freedom" loving Republicans passed to stop it.

All they really need to to is attach the PACT Act to an anti terrorism bill and prohibit all banks from processing sales for tobacco. A bill like that would not be as foolproof as PACT now but it would certainly cripple the industry. Please continue to write your legislators and educate people about snus until this bill is officially dead. Now is not the time to celebrate.
