Of course, so many things have been said, and I remain unsure of how it will actually work out, I guess I am a hopefull pessimist.

But these areas make me wonder, in that certain snus brands will not be allowed to be sold, because they have not been "approved" by the FDA, which means they have not gone through the procedure, and may not care to.

Yet, the nasal snuff companies seem to think, because their business is overseas, just like many of the snus busienesses, that FDA requirement, and PACT mail forbidding, does not apply to them.

So, why do Swedish companies believe it does apply to them, and are making efforts to comply, yet UK snuff companies believe it has no bearing on them at all?

If the UK snuff companies are right, then why would Northerner even care?

I hope Big Brother isn't reading this.

Because Swedish Match and Northerner have a physical distribution system in the U.S. Toque, for instance, does not.

I believe Roderick's position(and I hope he'll correct me if I have it wrong) is that there are trade/postal agreements in place internationally that would effectively supercede PACT, to the point that the USPS would have to deliver shipments from the UK(for instance) to customers in the U.S.---even if those shipments include tobacco products that would not be deliverable via USPS otherwise.

I'm not sure if the drafters of this ridiculous bill considered this. And, it may just end up being an Ace In The Hole for us.

Also, the bill has been passed by Congress and signed into law by President Barack H.(ypocrite) Obama, but I don't believe it has been reviewed by the Supreme Court yet. Has it? It could be declared unconstitutional in whole or in part. Remember, there are 5 conservative justices on the Supreme Court, and this could be one instance where that is a favorable condition.

I think that there is a lot of unknown information out there about the Pact Act. Frank with Northerner made a post earlier that British American Tobacco brands will not be available here due to the new requirements. I wrote to F&L (owned by BAT) about Granit not being available in the Unites Stated and they replied:

The only reason Granit will possibly not sold in US is that the "PACT Act" that will be put in place soon will prohibit sales of tobacco products via internet/postal orders. I guess this is the way you normally buy the product, but that will become illegal. I am nit (SIC) sure when this will be put in place.

Sorry but there is not much we can do......

        Med vänliga hälsningar,
        Kind Regards,

        Leif Hansson
Head of Global Smokeless Product Centre

        Fiedler & Lundgren AB

        -------------------------------------------------------------------------------------

I was amazed by their fast response to my email inquiry but am now more confused than ever. There is no mention of FDA or trademark issues only that we wont be able to order snus via the internet which doesn't seem to be the case from what I can see. There seems to be a lot of confusion about this act. I told Mr. Hansson about snuson and am hoping he will join. F&L makes Mocca and Granit and I would hate to see these products disappear.

There's confusion due to 2 agencies having their hands in the batter. To sell tobacco in the USA, companies have to disclose the ingredients they use to the FDA. That probably only applies to shipments from within the USA. I imagine shipments from the outside will still go through, as long as there aren't any banned ingredients(don't look for opium snus any time soon :^D)

For some it's the real possibility that certain brands won't be available to US customers. For others it's to avoid the greed tax imposed by state governments. And for some/all, it just feels right to "stick it to the man". I reside in all 3 categories...............
