    BUFFALO, N.Y. — Seneca Indian Nation cigarette sellers remain free to fulfill orders by mail in New York while a federal judge in Buffalo considers whether a law banning the practice is constitutional.

    U.S. District Judge Richard Arcara on Wednesday extended until July 30 a temporary restraining order that allows 141 members of the Seneca Free Trade Association and another Seneca businessman to continue to operate without having to comply with the Prevent All Cigarette Trafficking — or PACT — Act.

    The law that took effect June 29 bans using the U.S. Postal Service to ship cigarettes and requires sellers to comply with states' and municipalities' varying taxing laws.

    The Senecas, who dominate the national mail-order cigarette business, say the law unfairly targets nation businesses.

    I believe this bill have too much power and money to be struck down, imo.

    If you like your snus and snuff, United States isn't the place to be.

          I think the law has a great likelihood of being nixed. If 50 Departments of Revenue can not make heads or tails of it and if the people who wrote it can not explain compliance, and the penalties for non-compliance are as sever as they are.................well the court will see a big mess.

          I also think the law stands in violation of the Constitution with regards to out of state tax collection and the manner of the restrictions it places on USPS. It also violates our treaty with the Seneca nation.

                  everything else (including parcels & padded bags)
                  is a whole different story -- the new rates will
                  eventually be announced and we can cry some more!

                      Why don't they just get it overwith and raise the price of a stamp to $1.00
                      Every other month it's 1 cent, 2 cents. But at least USPS can deliver shit quick and unharmed. Unlike UPS. UPS should just go away.

                        The USPS lost a Priority Mail package I sent to a retailer
                        last year. I will never use USPS for a parcel again!

                          When it comes to packages, USPS usually makes the most trouble, with their carriers that don't give a damn or steal.

                            And unless you pay extra for tracking and insurance there is
                            no way to find a Priority package that is missing.

                            I used Fedex last time. I believe tracking was included in the
                            basic charge.

                              A couple of weeks ago I put tracking on a box pass. It was like 70 cents extra. So, if you are shipping something it is probably worth it, IMO.
