    FDA, FTC to tell manufacturers jolting alcoholic drinks are 'unsafe'

    WASHINGTON — Alcohol and caffeine will no longer mix in a popular drink that has won the wrath of state and federal regulators.

    Phusion Projects late Tuesday announced it would reformulate its products to remove caffeine, guarana and taurine nationwide.

    "Going forward, Phusion will produce only non-caffeinated versions of Four Loko," company co-founders Chris Hunter, Jeff Wright and Jaisen Freeman said in a joint statement.

    The three maintained that the combination of alcohol and caffeine is safe.

    "If it were unsafe, popular drinks like rum and colas or Irish coffees that have been consumed safely and responsibly for years would face the same scrutiny that our products have recently faced," they said.

    Phusion Project's products were approved by the Tobacco Tax and Trade Bureau, they said.

    Their announcement came as U.S. regulators planned to crack down on companies selling alcoholic beverages that include a jolt of caffeine amid pressure from lawmakers, states and consumer groups that contend the drinks are dangerous.

    Two U.S. agencies, the Food and Drug Administration and the Federal Trade Commission, are expected to warn manufacturers that adding caffeine to beer and other alcoholic drinks is unsafe and will caution them against marketing such beverages, Sen. Charles Schumer, D-N.Y., said Tuesday.

    Doing so "will effectively ban products from the market," Schumer said in a statement. He did not say when the agencies would act, and representatives for the FDA and the FTC had no comment.

    Schumer and other U.S. lawmakers, as well as attorneys general in states such as Connecticut, have lobbied heavily for some kind of federal regulatory action following reports of young adults across the U.S. passing out or being hospitalized after consuming the so-called alcohol energy drinks.

    Consumer advocates have also been urging tougher action against the drinks, sold mostly by privately held companies under the brands Four Loko, Joose and others. The cheap, fruit flavored drinks are growing in popularity, especially among college students, they say.

    "Compounded with its health risks, beverages like Four Loko pose a unique danger because they target young people," Schumer said, noting that such drinks can contain the caffeine equivalent of up to three cups of coffee and the alcohol equivalent of three cans of beer per container.

    Major beermakers have already abandoned such products.

    Units of Anheuser-Busch InBev NV and SABMiller Plc , the world's No. 1 and No. 2 brewers, pulled caffeinated alcohol drinks from U.S. shelves in 2008 after mounting pressure from several state attorneys general.

    Their absence left room for small, entrepreneurial players like Phusion Projects and its Four Loko.

    Several states have already implemented bans, according to Representative Rosa DeLauro, head of a House panel that oversees the FDA, who urged a ban earlier this week.

    Asked if the agency could act as early as Wednesday, FDA spokeswoman Beth Martino said the agency "is reviewing the scientific data regarding the safety of these drinks" but declined further comment.

    I wonder how many other can collectors around the country will be

    Never tried it. I did try some 'Sparks' that a friend gave me once, and I didn't really care for it... No thanks, I'll just have some good ol' beer instead.

    I don't see this reformulation being successful for the company. I mean that is the whole point of the brand, right? It would be like a neutered Red Bull or nicotine-free Cigarettes.

      What's up Seattleite. I've never see you post before, so from one Seattleite to another, welcome to snuson. I saw a girl at a Halloween party on Crapitol Hill drinking Four Loko and asked her for a sip. Mountain Dew with lots of alcohol. Nasty. If I need that kind of kick, I'll take a strong Belgian and a No Doz.

        I think they could maybe just lower the stimulant amount, and I'd like to see a diet version, without the sugar. I am suprised no one has made a sugar free sweet alcohol drink, like schnapps.

          In my younger days I'd have a cup of coffee or two before I went out so I understand the concept. I think the consumers are being irresponsible for the most part, but it seems as if this product is wicked strong. That coupled with the fact that it's sweet like Mt. Dew? Hangover city, if you ask me and I learned that very early on...but some people don't learn. I don't think it should be banned, but maybe toned down a little bit. People are going to mix this combo anyhow. Seems to me that it's more dangerous than snus...maybe the warning labels should be more than 50% of the can. I guess you could die from consuming six to eight cans of snus in rapid succession, but we all know where you have to put them for that to take place.

            I drink Sparks once in awhile, for those all night gaming sessions, but one is enough, then I switch over to regular beer. I guess they'll be going after Energy snus next?!?

                Before Crash, Teen Drank Four Loko

                MESA, Ariz. - We're learning more about a teen who smashed her sport-utility-vehicle into a house near Alma School over the weekend.

                It turns out she was playing a drinking game with a controversial energy drink that contains caffeine and alcohol.

                Mesa Police say 18-year-old Lanae Cummins had a blood alcohol content of 0.15 Sunday night, which is an extreme D.U.I.

                Cummins told officers she was drinking Four Loko.

                The drink is controversial because it's an energy drink and contains 12 percent alcohol - the equivalent to the amount of alcohol in a glass of wine - and comes in 24-ounce cans. It's like drinking four 12-ounce beers and 3 cups of coffee at once.

                Cummins remains hospitalized with some cervical fractures.

                Four Loko has been banned in Washington, Michigan, Utah and Oklahoma.

                "Its tragic that these kinds of things have to come out in this way," says Mika Marquart with the Arizona Attorney General's Office. The AG's office has encouraged the FDA to review these caffeinated-alcoholic drinks.

                "One of our biggest concerns is that these drinks are being marketed towards young people, people who arent necessarily of age to drink, or if they are, they're not experienced drinkers."



                Lanae now whining: "Can't a girl just have some fun without everyone getting on her case?"

                  There is a big wave of people going back to retro traditional drinks (people over 29), which seems to be heavily influenced by the show "Madmen" and old brand marketing.

                  The kids will always like the sweet stuff that does not taste like oak water or paint thinner though.

                      All this because a bunch of 19 year old college students were found unconscious and had to be hospitalized here in Washington, just over the Cascades in a little town that was the set for that TV show Northern Exposure. Maybe you all heard the story, but just in case, the assumption was that all these girls and 1 or 2 dudes were slipped some kind of date rape drug. After 3 weeks of toxicology proceedings they tested positive for... Alcohol. Oh heavens me and caffeine too. Not sure what's wrong with these kids that they wind up in the hospital from a canned beverage. What happened to the days of 2 or 3 freshmen putting back $11 half-gallons of the nation's shittiest and cheapest vodka available? P*ssies.

                          Guys, this is a scam from the nanny state yet again. When they say "dangerous", they don't mean like it could kill you, they mean that some idiot may drink himself to death because he doesn't feel it because of caffein.

                          1) ALCOHOL in large quantities is dangerous. Should we ban water and bread as well, because if you drink while using either of those too it can make you feel less drunk as well? If the drink caused cancer or something that would be different, but it's just the state trying to protect people from themselves.

                          2)Ive drank that shit a bunch of times. I am a pretty heavy drinker and 1 can of it gets me nice and saucy, I don't know wtf all these people are saying about how the caffein makes you not feel drunk. Anyone who's ever had coffee while drinking or a redbull and vodka knows you still get shitty trashed if you drink a few.


                          This is all nonesense. In many liquor stores, 4 loco, JUICE, etc were the only beverages I can buy with 12% alcohol in them. That way I can get a nice buzz without having to drink 6 bud lights. They better just take the caffein out and not change the alcohol content.
