Guys, need some legal advice

    Yah, pretty much my case stands on this premise:

    Impound lot can't sell vehicle without asking DMV first. DMV tells them if ther is a hold or not. I went to DMV to recover the bike and they gave me a paper showing that there is a hold, then right after that the impound lot asked the DMV to give them permission to sell it, DMV told them "sure, no holds here!", yet when I ask themthey say "sorry, there's a hold". I have this all on paper with printouts from teh DMV.


    Hopefully I can win, but I can see a thousand ways they will try to spin this. I am just curious how hard it will be to get mney out of the DMV n this day and age. I just want them to pay me for what the bike was worth when they sold it. This is complicated because to expedite the sale they claimed it was only worth like a thousand dollars for the purpose of the sale.

    Someone out there is driving a nice brand new/barely used Yamaha R6 for only $1000. I'd like to kick that man right square in the nuts.

        Cali has to get out of debt some how right? What better way than to have local police steal a car/motorcycle wait for it to be reported stolen, "find" it and then charge large amounts of money for every process involved to get it back.

          Weak... I have no idea what you could do. Our legal system is rigged in favor of the house. All your perfectly logical arguments will fall on deaf ears, and they'll tell you to **** yourself. Their "law" is illegal in the first place. That's a seizure without just cause AFAIC. They can call it any ****in' thing they want, but in the end, they illegally took your property, and denied you your constitutionally protected rights :^S

            Yah that's how i see it too. They sold a 10,000$ vehicle for the crime having it stolen from me. ****ing dicks.

            I'm not confident I'll get money from them even with all this solid evidence. I'm waiting for a lawyer to call me back but I'm pretty sure I just got had by the government.

              You are going to need to hire an attorney to have a decent shot at recovering anything.

                  That is the most F**ed up thing I have heard in a long time. I'd sue for the note on the bike, the lost use of the bike, and emotional duress.

                  I'd find an attorney who is a complete asshole, and will give your case his full attention.

                  I'd call your local news. Here in SC they are always running News4 on your side stories about this kind of thing.............they go down and interview the buttheads and put them on the spot....................until the city (or whoever) makes good on their part. Regardless, this sort of practice is exactly what the citizens in your area need to know (and just what the official don't want them to know). I think there is a good chance that the local station would find this news worthy especially if you presented it as a greater concern.

                    I have since had a falling out with the mother-in-law because of this whole "her son selling my bike for meth" thing, but last I heard was that she was forced to renovate the entire restaurant and install a handicap accessible bathroom, change the counter-top heights etc.

                    In the end she spent a small fortune but it does look a lot better now so that will be good for business. So yah long story short is that he won and she spent thousands having to re-model the entire restaurant and close for business while it was happening.



                    @ Snusdog: I've never called the news before, do they really care about little things like this? I will consider hitting them up, though I don't even know who my local news station is! lol. I called the San Francisco BAR association's referral system so they took my story and said a lawyer willing to take the case will call me back by tomorrow. Hopefully they have good news for me, otherwise I am just utterly ****ed.

                    I just can't believe my vehicle is gone, and the thief never even went to jail or had a trial, they didn't even TRY to penalize him, but they SOLD MY VEHICLE since I am the real criminal here. I can't believe I will never ride my bike again because of this, and I can't sue any of the 2 people who stole the bike since they are both low-life welfare queens and therefore have no money or assets to seize.

                      I would really try and work it out with the police department first. It sounds like they screwed up and have very little control over their towing contractor.

                        Actually they have complete control of their towing contractor and still let this happen. I have been calling the Sgt in charge of my case for days and have been calling constantly asking the receptionist to connect me with ANYONE who will at least hear my story, but so far it has been days and I have yet to be able to talk to anyone. I have no one to call or talk to, and the guy I need is always away from his desk.

                        Gotta have a lawyer do it. If no lawyer will take my case tomorrow than I am pretty much screwed.
