Body camera video shows East Texas police shoot, kill man who pulled fake gun
The Palestine Police Department has released graphic body camera footage of a fatal altercation in May between two of its officers and a man accused of stealing beer outside of an Applebee's restaurant.
Footage uploaded to YouTube shows Palestine Police Sgt. Gabriel Green and Officer Kaylynn Griffin confronting James D. Bushey, 47, in the Applebee's bathroom on May 31 before leading him outside. The two officers had been alerted that Bushey had allegedly attempted to lift a case of beer from a nearby Walmart.
"What do you need?" Bushey asks the officer Green in the videos. Green tells the man that he is a suspect in a theft case and asks him to step outside of the restaurant.
"Don't act dumb, come on and step out. You're on video, okay?" Green says when Bushey does not reply.
The officers are shown escorting Bushey — wearing a Dos Equis shirt and a baseball cap with a "Walking Dead" logo on it — outside, where the 47-year-old brandishes what appears to be a pistol and Green tries to control.
Griffin screams "Gun! Gun! Gun!" as Green releases Bushey, who dashes away and attempts to point the gun at the two officers.
Green is shown firing about nine rounds at Bushey while Griffin fires three to four.
Officers later determined that Bushey's gun, fashioned to resemble a Colt 1911 .45 caliber handgun, was a BB gun..
