    FDA Bill Effects on American Tobacco

    if we can have a REAL discussion about this, i'd like to. don't discuss conspiracies, or anything crazy, but i'd like to talk about how this is going to affect tobacco. and let's do this without going into any "we can't get snus anymore!" craziness.

    from my understanding:

    * The FDA will be able to limit tobacco levels on existing products.
    * Outlaw candy/fruit flavored tobacco products.
    * State that smokeless tobacco is not as safe or safer than cigarettes. However the FDA can evaluate new products and determine IF they are safer alternatives to smoking and introduce them as such.
    * Harsher warning labels on cigarettes. (WARNING will be in ALL CAPS and cover 50% or more of the box)
    * Menthol is safe:
    "Menthol happens to be the most popular cigarette flavor, and the Journal reports that the Congressional Black Caucus pressed for the carve-out. Menthol brands account for less than 30% of the U.S. market but are favored by 75% of black smokers. Black public health officials understandably have opposed the exemptions. But black lawmakers apparently believe that banning an unhealthy product used by a disproportionate number of black voters is the greater evil."
    * Forces disclosure of all ingredients in tobacco
    * Bans tobacco sponsorships of sports and entertainment events
    * Gives the FDA power to approve or ban new tobacco products from being introduced into the market
    * Bans terms like "light", "ultra light" and "low tar" from cigarettes.


    one good thing stated by the Bush admin:
    The Bush Administration resisted efforts to give the agency such authority by arguing, among other things, that the FDA was barely competent to regulate the products already on its plate.

    This bill however does not affect sales of tobacco products (snus, snuff, cigarettes, shisha, cigars, etc) through the mail, which are still legal until the PACT Act passes the Senate and is signed by President Obama.

    does this sound about right guys?

    Sounds exactly as I have come to understand it. All in all, I don't see "too much" danger in this bill. Other then the ability to stop new products, but SM has already advised that they were on the market here before the cut off date, so "snus" is NOT new to this market according to the bill.

    Obviously, I'd love the Government not to be too involved. but that is what Governments do. And honestly, i think we all agree that we feel fortunate that snus is regulated by the Swedish government the way it is. Honestly, big reason I trust Swedish snus over American snus.

    So done right, I'm not sure it will be that bad. "Done right" being the operative phrase though. :lol: :lol:

      There are few things that surprise me...but this...I just don't know how to take it :lol: . It's like saying 'We're gonna outlaw all the flavors except the ones people really, really like!'.

          Does this bill ban shipping snus through the mail?? I hope not, because I don't know of any stores in my area that carry Swedish snus....I don't want to have to resort to Camel Snus or American dip....or be driven back to smoking....

            THE FDA bill doesn't. There is another bill coming, the PACT act that will. Still unclear how private carriers will be affected. the bill doesn't stop them, but I have "heard" that they agreed not to ship tobacco as well. Only time will tell how this all shakes out.

                .. and to control contents of cigarettes. That was a debate sticking point. What if the FDA says it wants some specific carcinogen removed from the Camel cigarette? And RJR says "no can do" cause we don't have the technology to selectively remove such things.

                What then?

                This bill says RJR would be in violation and subject to penalties. I agree with North Carolina Sen. Kay Hagin that nothing should ever be proposed if the technology does not exist to do it. But that's not the clear case with the new bill.

                My complaint is mostly with the clampdown on new products. The bill blocks potentially safer alternatives being developed and brought to market now, while protecting Philip Morris' market share. Not right.

                        Seriously, I've crossed it out of my mind. It was really messing with me and I decided that no matter what, I'll always have an out. If I can't get it from Sweden, I'll have to drive up to NC or Charleston once or twice a year and get some General. If not, I'll pursue making my own. The government can ban flavoring and mailing snus all they want, but (so far) they can't stop me from going to the farmers market once a month and buying some stalks and cooking them in my oven.
