    The final rules have been issued regarding the mailing of tobacco. Nothing new but here is the link.

    Interesting for you pipe smokers:

    A commenter noted that the proposed rule does not expressly provide that pipe
    tobacco is mailable. The PACT Act restricts the mailability of items that the Postal
    Service has reasonable cause under the PACT Act to believe contain cigarettes or
    smokeless tobacco, as those terms are defined in Section 1 of the Jenkins Act of 1949
    (15 U.S.C. § 375(2), (12) (as amended)). If a product falls outside of the PACT Act’s
    definitions for cigarettes or smokeless tobacco, then the product is not subject to the
    PACT Act’s restrictions, except where it happens to fall within the scope of the PACT
    Act’s reasonable cause standard. The fact that the PACT Act explicitly acknowledges
    the mailability of cigars, but not pipe tobacco or other extraneous tobacco products,
    does not suggest the nonmailability of those other tobacco products.

        "Another commenter inquired whether it would be permissible to mail two to three cans of “snus” from Sweden to a friend in the United States. Because the Postal Service understands snus to be a form of smokeless tobacco, as defined by the PACT Act, it would fall within the scope of the rules at hand. As explained in the proposed rule, the complex verification requirements for the PACT Act’s exceptions, combined with the strict consequences of any noncompliance, render it impracticable for these requirements to be made applicable to mail originating or destinating outside of the United States. Therefore, the Postal Service does not believe that any alternative exists at this time to allow U.S. persons to send or receive smokeless tobacco products, such as snus, in international mail under the PACT Act’s exceptions."

          Hello All,

          This is my first post to the forum... I am in disbelief this law was actually passed as it infringes on our contitutional rights dealing with interstate commerace. I've researched this alot over the past few weeks and I should fisnish up a letter to mail to my elected officals tomorrow. FYI, only 25 members of congress voted against this bill (20 Reps and 5 Dems). I guess the biggest thing that bothers me is that as a service member stationed in the middle east, I will no longer be able to order snus or have it mailed to me! That would be all well and good if the base exchange stocked it but they don't!

          There are 2 exceptions that allow tabacco products to be mailed to an APO address and they are it must be mailed by military express mail (if available at the APO location) and the package can not contain more than 10 ounces of product. The kicker to that is that a person is not allowed to recive more than 10 packages per 30 day period.

          The costs asscoiated with mailing parcels at the express rate is going to be ridiculous. To top that off, military express mail is not available at my APO or the majoirty of APO's in the middle east! What gives????? I mean it's one thing to take my booze and porn but don't mess with my tabacco!

          So I sucked it up and just placed an order for 100 cans from northerner.com.

          Unbelievable.....

              I don't disagree, but a roll of portions is less then 10 ounces and you would normally be able to do this 10x a month.

              I could get by on 100 cans a month.

                  Sorry to hear about the APO shipping. Even though we will end up paying $100.00 bucks to ship snus, we will still be able to get it. Are you required to declare contents when shipping APO? Can a friend send you some in a plain brown box?

                    This may be a really dumb question, but can't people get around this by putting snus cans in empty Quaker Oats cans, Twinkie boxes, Pringles, etc.?

                      I love it! We will now be forced to drive to Mexico, buy a ton of snus, stuff our car seats and gas tanks with it and try and make it across the border.

                        Can get everything from Mehico, add snus to the list. Next Liquor. Who knows it may cut down on illegal immigration. Everyone just stays there and organizes getting "stuff" for desperate gringos.

                          Sure people send millions of pounds of weed, prescription drugs, weapon parts, and for all we know nuclear material, and biological weapons through the mail. Plus if you got caught you won't get as tough a penalty as sending drugs.

                            First, thanks for serving. I did four years in the Navy from 87-91 and you do give up a lot.

                            Second, it is unfortunate but the idiots who decide your fate don't know the first thing about the constitution and don't merit the sacrifice..........whatever you do over there, do it for your buddies, they are worth it. Dubya referred to the constitution as a G__ D____ piece of paper and it's obvious Obama is no improvement.

                            But yes, PACT, in addition to being a trade restriction rather than regulation actually violates several U.S. treaties with soveriegn indian tribes. The Senecas are hopping mad and it was pretty much the State of New York that got the ball rolling on the PACT act to prevent their own hapless citizens from legally circumnavigating their exhorbitant cigarette tax which is expected to hike the price up to $10 a pack.

                              It's already $11 a pack at many places.
